“Promises were made then excuses came after deposit given. So buyers beware!! Any off the plan deals John Heng represents (282 Ham rd, Wishart). I want to warn you that the sunset clause does not protect the buyer. Meaning here in QLD should the developer want to capitalise on increase land prices the developer can at their own discretion slow down completion to exceed the 18 month completion date and rescind the contract. The developer can then place back on the market at a higher price. The buyer has also the right to do this however considering the land prices rarely depreciate it will always be in the developers favour. This property was on the market 1 year ago with the plan to register in 3months. They are happy to take your deposit earn interest off, and the only control you have is hope and dreams that the developer will follow through. His new advertisement in Ray& White real-estate says exactly the same when it was first advertised through Place real-estate agency 2020. Now you know the risk its your choice. Also be aware in VIC and NSW 3years ago a bill was passed to protect the buyers from developers who have been doing this. Where both parties need to agree and have option to extend the sunset clause before the contract can be rescinded. Unfortunately in QLD it has yet to follow, due to this bill most developers have moved to their business up here which I also discovered this particular developer also comes also from VIC.”
